LoadViewer is a software platform operated by Yastika Eclectic Software, a sole proprietorship owned by Sajjan Kumar. In this document, “we”, “us”, and “our” refer to Yastika Eclectic Software.

Privacy Policy

We respect your privacy and are committed to protecting personal information provided by users of our platform.

1. Information We Collect

• Personal information such as name, email address, billing details, and contact information.
• Usage data including IP address, browser type, device information, and platform activity.
• Operational and user-generated data including shipment details, cargo descriptions, uploaded files, imported data, and content created within the platform.

2. Use of Information

• To provide and maintain the service.
• To communicate regarding service updates and support.
• To process shipments, generate solutions, and provide platform functionality.
• To improve product performance, reliability, user experience, and generate aggregated, anonymized platform insights.
• To comply with legal and regulatory obligations.

3. Data Security

We implement reasonable technical and organizational safeguards to protect personal data. However, no digital transmission can be guaranteed as fully secure.

4. Third Parties

We may share limited information with payment processors, accounting providers, and analytics tools strictly for operational purposes.

5. User Rights

Users may request access or correction of their personal data. Requests for deletion will be honored by removing or anonymizing personal identifiers where complete removal is not technically feasible or would affect system integrity, transaction records, or legal obligations.

6. Data Retention and User Backups

We retain user shipment data and generated solutions for a limited period, currently up to three (3) months, subject to change at our discretion. Users may delete their shipment data from the platform at any time.

Users are responsible for downloading, exporting, and maintaining their own copies of shipments, solutions, and related data. We shall not be liable for loss of data after the retention period or due to user failure to maintain backups.

Retention periods may vary to comply with applicable laws, tax obligations, accounting standards, or operational requirements.

Terms of Use & Master Service Agreement (MSA)

By accessing LoadViewer, creating an account, purchasing subscriptions or Coins, you enter into a legally binding Master Service Agreement with us.

1. Scope of Service

LoadViewer is a cloud-based software platform operated by us providing container and cargo load optimization tools through subscriptions and prepaid usage credits (“Coins”).

2. AI & Algorithmic Outputs

LoadViewer may use algorithmic or AI-assisted processes to generate load plans. Users remain responsible for verifying suitability, compliance, and operational safety of all outputs.

3. Digital Outputs and Delivery

Services are delivered electronically through downloadable files including CSV data exports and PDF solution reports. Delivery is deemed complete upon availability of such files within the platform.

4. Processing Time and Solver Availability

Solution generation times may vary based on shipment complexity, system load, and queue volume and may range from minutes to several hours. No guaranteed turnaround time is provided unless expressly agreed in writing.

5. User Generated Content (UGC)

User Generated Content includes all text, shipment names, SKU descriptions, profile details, uploaded files, imported data, and any material submitted by users.

Users shall not upload content that is abusive, defamatory, obscene, pornographic, unlawful, misleading, or infringing on third-party rights.

6. Prohibited Conduct

• Unauthorized access or system interference
• Uploading harmful or illegal content
• Reverse engineering or misuse of platform

7. Suspension & Termination

We may suspend or terminate user accounts at our discretion for violations of these Terms, unlawful activity, security risks, non-payment, or misuse of the platform.

8. Content Takedown

Upon receipt of a valid written complaint or identification of prohibited content, we may remove, restrict, or disable access to such content within a commercially reasonable timeframe.

9. User Access and Permissions

Users are responsible for assigning and managing editors, viewers, and access permissions within their accounts. We shall not be responsible for actions taken by authorized users or misuse arising from granted permissions.

10. Orders, Subscriptions & Coins

• Coins represent prepaid service credits redeemable for LoadViewer features
• Subscriptions grant time-based access to platform features
• Pricing may vary by plan, volume, promotion, or commercial agreement
• All payments represent full consideration for digital services rendered

11. Taxes & Export Treatment

Applicable taxes are determined based on place of supply and governing tax laws. Export transactions may qualify for zero-rated GST subject to verification of foreign remittance evidence. Users are responsible for providing accurate tax classification and place-of-supply information at the time of payment.

12. Chargebacks, Fraud & Payment Disputes

All payments made for subscriptions or Coins provide immediate access to digital services and are deemed fully delivered upon activation or usage.

Users agree not to initiate chargebacks, payment reversals, or disputes for services already accessed or consumed. We reserve the right to suspend accounts, revoke access, and recover associated losses or fees.

13. Adjustment of Service Credits

We reserve the right to suspend, adjust, or revoke Coins or subscription access where: (a) payment is reversed, disputed, charged back, or not fully realized; (b) incorrect tax declarations or place-of-supply information is provided; (c) export remittance conditions required under applicable law are not satisfied; or (d) material misrepresentation affects pricing or eligibility.

14. Export Compliance

Users agree to comply with applicable export control and trade laws and represent they are not located in prohibited jurisdictions or sanctioned lists.

15. Indemnification

Users agree to indemnify and hold harmless LoadViewer and Yastika Eclectic Software from claims, damages, losses, or liabilities arising from misuse, user content, or legal violations.

16. Limitation of Liability

We shall not be liable for any indirect, incidental, consequential, special, or business losses arising from use of the LoadViewer platform.

17. Limitation of Damages

In no event shall our total liability exceed the total amount paid by the user to us in the twelve (12) months preceding the claim.

18. Force Majeure

We shall not be liable for failures caused by events beyond reasonable control including natural disasters, governmental actions, internet outages, or regulatory changes.

19. Intellectual Property

All software, algorithms, designs, content, and platform functionality remain the exclusive property of Yastika Eclectic Software.

20. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of India. Courts in Gurugram, Haryana shall have exclusive jurisdiction.

21. Dispute Resolution & Arbitration

Disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996 of India. Seat: Gurugram, Haryana. Language: English.

22. No Collective or Class Actions

Disputes must be brought individually and not as group, collective, or class actions.

23. Independent Relationship

This Agreement does not create partnership, agency, joint venture, or employment relationships.

24. Severability

If any provision is unenforceable, remaining provisions continue in full effect.

25. No Professional Advice

LoadViewer provides informational tools only and does not constitute engineering, legal, or regulatory advice.

26. Electronic Acceptance

Use of the platform constitutes legally binding electronic acceptance of this Agreement.

27. Modifications

We reserve the right to update these Terms at any time. Continued use constitutes acceptance.

Cancellation & Refund Policy

All digital services, subscriptions, and coins once purchased are non-refundable and non-transferable unless required by law.

Shipping Policy

No physical goods are shipped. LoadViewer provides only digital services.
